Degrees of Sexual Assault Charges

Rape is defined as compelling or forcing someone else to engage in sexual activities. Despite this clear-cut definition, there are actually varying degrees of sexual assault in the criminal justice system. To better challenge your charges and what is being said about you, understanding the differences between the degrees is key.

First degree: Forced nonconsensual intercourse, or any intercourse with someone under the age of 11.

Second degree: Nonconsensual intercourse with someone with a mental incapacitation or debilitation, or any intercourse with someone under the age of 15.

Third degree: Intercourse of any kind with someone under the age of 17.

Penalties for Sexual Assault and Rape in New York

Sexual assault or battery is always considered a felony in New York State legislation. The specifics of the case will determine what degree of a felony it constitutes. Third degree rape, for example, can penalize you with four years in prison, whereas first degree may be 25 years or more. All convictions will also include a fine to the state and mandatory sex offender registration. The registration is often the most damaging of all penalties, as it can follow you around for the rest of your life. If you have been forced to register as a sex offender in New York, educational institutions and employers all around the country can refuse to work with you based solely on that one conviction.
